1. Acceptance of Terms

By accessing and using PainOnSocial ("Service", "we", "us", or "our"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this Service.

2. Description of Service

PainOnSocial provides an AI-powered platform that analyzes Reddit discussions to identify and surface validated pain points from online communities. Our Service includes:

  • Access to a curated catalog of Reddit communities (subreddits)
  • AI-powered analysis of Reddit discussions using third-party APIs (Perplexity and OpenAI)
  • Pain point discovery, scoring, and ranking based on frequency and intensity
  • Evidence-backed results with quotes, permalinks, and community metrics
  • Scan history and results tracking

The Service is designed for entrepreneurs, product teams, market researchers, and business professionals seeking to identify real user problems and market opportunities.

3. User Accounts and Registration

To use the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate and complete
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • Use the Service only for lawful, legitimate business and research purposes

You must be at least 18 years old to use this Service.

4. Subscription Plans and Payment

PainOnSocial offers multiple subscription tiers with different usage limits:

  • Free Trial: 1 scan per day, up to 3 subreddits, 7-day timeframe
  • Starter ($19/month): 5 scans per day, up to 10 subreddits, 30-day timeframe
  • Professional ($49/month): 20 scans per day, up to 30 subreddits, 90-day timeframe

By subscribing to a paid plan, you agree to:

  • Pay all applicable subscription fees as described in our pricing plans
  • Provide current, complete, and accurate billing information
  • Authorize us to charge your payment method on a recurring monthly basis
  • Be responsible for all charges incurred under your account

Subscription fees are non-refundable except as required by applicable law. We reserve the right to change our subscription plans or adjust pricing with 30 days' advance notice. You may cancel your subscription at any time through your account settings.

5. Usage Limits and Fair Use

Your subscription tier determines your daily scan limits, number of subreddits, and analysis timeframe. You agree to:

  • Respect the usage limits associated with your subscription tier
  • Not attempt to circumvent or bypass usage restrictions
  • Not use automated tools or scripts to access the Service excessively
  • Use the Service in a manner that does not negatively impact other users

We reserve the right to temporarily or permanently suspend accounts that violate fair use policies or attempt to abuse the Service.

6. Acceptable Use and Prohibited Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service in any way that violates any applicable laws or regulations
  • Use the Service to harass, stalk, or harm individuals or communities
  • Use the results to create spam, unsolicited marketing, or manipulative content
  • Attempt to reverse engineer, decompile, or extract source code from the Service
  • Attempt to gain unauthorized access to any portion of the Service or our systems
  • Interfere with or disrupt the Service, servers, or networks
  • Impersonate any person or entity or misrepresent your affiliation
  • Share your account credentials with others or create multiple accounts to bypass limits
  • Scrape, copy, or redistribute our curated subreddit catalog for commercial purposes
  • Use the Service to violate Reddit's Terms of Service or User Agreement

7. Third-Party Content and Reddit Data

Our Service analyzes publicly available Reddit content. You acknowledge and agree that:

  • Reddit content is subject to Reddit's Terms of Service and User Agreement
  • We provide links to original Reddit posts but do not host or own Reddit content
  • Pain point analysis represents AI-generated interpretations and may not be perfect
  • The accuracy, completeness, or reliability of Reddit discussions is not guaranteed
  • You are responsible for how you use the insights and information provided by our Service
  • We are not liable for any decisions or actions you take based on the pain points discovered

When using information from our Service, you must respect the intellectual property rights of Reddit users and comply with Reddit's policies regarding content usage.

8. Intellectual Property Rights

Our Intellectual Property

The Service and its original content, features, functionality, software, AI models, prompts, subreddit catalog, and user interface are owned by PainOnSocial and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

License to Use Results

You retain the right to use the pain point insights, scan results, and analysis generated through your use of the Service for your own business and research purposes. However, you may not resell, redistribute, or create derivative services based on our platform or results without written permission.

9. AI-Generated Content and Accuracy

Our Service uses artificial intelligence (Perplexity API and OpenAI) to analyze Reddit discussions and generate pain point insights. You acknowledge that:

  • AI-generated analysis may contain errors, omissions, or inaccuracies
  • Pain point scores and rankings are algorithmic interpretations, not objective facts
  • Results should be validated and verified before making business decisions
  • We do not guarantee specific outcomes or business results from using our insights
  • AI models may be updated or changed, which could affect result consistency over time

The Service is designed to assist with research and discovery, not replace human judgment and due diligence.

10. Privacy and Data Collection

Your use of our Service is also governed by our Privacy Policy. We collect and store information about your account, subscription, scan history, selected subreddits, and usage patterns. Please review our Privacy Policy to understand our data collection and usage practices.

11. Service Availability and Modifications

We strive to provide reliable service but cannot guarantee uninterrupted access. We reserve the right to:

  • Modify, suspend, or discontinue any aspect of the Service at any time
  • Perform maintenance that may temporarily interrupt service availability
  • Update our subreddit catalog, adding or removing communities
  • Adjust AI analysis algorithms and scoring methodologies
  • Change subscription tiers, features, or pricing with notice

We will make reasonable efforts to notify users of significant changes that may affect their use of the Service.

12. Disclaimers and Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES OF NON-INFRINGEMENT
  • ACCURACY, RELIABILITY, OR COMPLETENESS OF AI-GENERATED INSIGHTS
  • AVAILABILITY OF REDDIT CONTENT OR THIRD-PARTY APIs
  • THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • THAT DEFECTS WILL BE CORRECTED OR THAT RESULTS WILL MEET YOUR EXPECTATIONS

No advice or information obtained from us or through the Service shall create any warranty not expressly stated in these Terms.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAINONSOCIAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • YOUR USE OR INABILITY TO USE THE SERVICE
  • ANY BUSINESS DECISIONS MADE BASED ON OUR AI-GENERATED INSIGHTS
  • INACCURACIES, ERRORS, OR OMISSIONS IN PAIN POINT ANALYSIS OR REDDIT DATA
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR YOUR ACCOUNT
  • ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE
  • THIRD-PARTY CONTENT, INCLUDING REDDIT DISCUSSIONS AND API SERVICES
  • ANY BUGS, VIRUSES, OR HARMFUL CODE

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

14. Indemnification

You agree to defend, indemnify, and hold harmless PainOnSocial and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms of Service
  • Your use or misuse of the Service
  • Your violation of any third-party rights, including Reddit's terms
  • Any business decisions or actions taken based on our insights
  • Your breach of any applicable laws or regulations

15. Termination and Account Suspension

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms of Service
  • Violation of our acceptable use policies
  • Non-payment of subscription fees
  • Fraudulent or abusive behavior
  • Exceeding usage limits or attempting to circumvent restrictions

Upon termination, your right to use the Service will cease immediately. You may cancel your subscription at any time through your account settings. Upon cancellation, you will continue to have access until the end of your current billing period.

16. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, or in the courts of Quebec, Canada. You waive any right to a jury trial.

17. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Material changes will be communicated via email or through a prominent notice on our Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

18. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

19. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and PainOnSocial regarding your use of the Service and supersede all prior agreements and understandings, whether written or oral.
